Updates on the Meta Cases

The Meta cases are a set of three cases filed against Meta. Two are filed on behalf of former Facebook Content Moderators alleging human trafficking for labour, forced labour, modern slavery, discrimination, violation of labour rights, intentional infliction of mental health harm and unlawful termination.



The third case is a class action suit filed by Abraham Meareg Fisseha Tekle and Katiba Institute, on behalf of every African whose content was being moderated in Kenya between 2019 and 2023. It explores the manner in which the Facebook platform and its algorithm are designed to be discriminatory against Africans and allow Meta to benefit from hate speech, propaganda for war and incitement to violence, all of which are against the Constitution of Kenya.


We recently received a Court of Appeal decision in the Facebook Content Moderators cases affirming that the Employment and Labour Relations Court has jurisdiction to hear the two cases.




Currently, we are litigating a subsequent application by Meta on whether or not the jurisdiction issue should be heard by the Supreme Court.


The algorithm case awaits a decision by the Constitutional court on 7th April 2025 on whether the court has jurisdiction over Meta, and whether the case raises substantial questions of law that ough to be heard by a panel of judges.
